New Delhi, August 21: The online gaming industry in India has sounded the alarm over the Promotion and Regulation of Online Gaming Bill, 2025, which proposes a sweeping ban on all real-money online games, including those traditionally considered skill-based. Industry leaders warn that if the bill is passed in its current form, it could devastate one of India’s fastest-growing digital sectors, resulting in tens of thousands of job losses, the closure of hundreds of companies, and a sharp reduction in sports sponsorship revenues.

The Bill and Its Scope

The bill, drafted by the Union Ministry of Electronics and Information Technology (MeitY) and introduced in the Lok Sabha on August 20 by IT Minister Ashwini Vaishnaw, spans 14 pages and seeks to comprehensively prohibit “online money games.”

It defines such games as:

“An online game irrespective of whether such game is based on skill, chance, or both, played by a user by paying fees, depositing money, or other stakes in expectation of winning, which entails monetary and other enrichment in return of money or other stakes; but shall not include any esports.

This broad definition would bring within its ambit fantasy sports, rummy, poker, prediction markets, and other skill-based games that have long argued for their differentiation from games of chance. The exclusion of esports is notable, as competitive gaming without monetary stakes continues to enjoy recognition as a legitimate sporting activity.

Industry Impact: Jobs, Companies, and Sponsorships at Risk

According to industry sources, the consequences of such a ban would be catastrophic. “There are more than 20,000 jobs at immediate risk, with a possibility of over 300 companies shutting down,”

The cascading effect could extend beyond the gaming sector itself. Nearly 50% of domestic and national-level sports leagues, especially those outside of cricket, rely heavily on sponsorships from real-money gaming companies. Industry observers predict that a ban would result in sponsorship revenue losses of 30 to 40%, potentially crippling non-cricket sports and undermining grassroots development initiatives.

“Non-cricket and grassroots sports may collapse without real money gaming advertisers,” the executive warned. “The impact could trigger a domino effect — lower ad spends, reduced sports broadcasting revenues, and a decline in media investments.”

A Multi-Billion Dollar Market Under Threat

India’s online gaming sector is among the most dynamic in the country’s digital economy. According to venture capital firm Lumikai, the industry is currently valued at $3.8 billion and projected to grow to $9.2 billion by 2029. It employs over 130,000 skilled professionals in game design, software development, content moderation, and customer support.

The sector has attracted significant global investor interest in recent years, with venture funds and tech giants betting on India as a future leader in skill-based online gaming. A blanket ban, critics argue, risks wiping out years of progress and deterring future capital inflows.

Legal Experts: Blanket Ban vs. Regulated Growth

Legal experts caution that treating skill-based gaming platforms on par with gambling operations is problematic. Ganesh Prasad, Partner at Khaitan & Co, explained:

“The industry has been consistent in voicing its primary concern: that a blanket ban equates legitimate, regulated, skill-based gaming platforms with predatory gambling models. Overregulation through a blanket ban could stifle innovation in a sector where India has the potential to lead globally.”

Prasad also highlighted the importance of regulatory predictability for investors. “From a policy standpoint, it’s worth noting that stability in regulation is critical for investor confidence. Sudden prohibitions without a long-term roadmap risk deterring both capital and talent from entering India’s gaming ecosystem,” he said.

The Case for Opinion Trading

One of the emerging areas affected by the bill is opinion trading or prediction markets. In India, these have been treated as games, but in the United States they are regulated as financial instruments under the Commodity Futures Trading Commission (CFTC).

Anurag Dhandhi, Business Head at Probo, explained the difference:

“Opinion trading is a tool for economic insight, information aggregation, and forecasting. It enables users to apply judgment, knowledge, and analysis to real-world developments. By fostering informed participation, it goes beyond entertainment.”

Dhandhi argued that rather than being dismissed as gambling, prediction markets can contribute to financial literacy, data-driven decision-making, and strengthening the larger digital economy. He urged the government to recognize opinion trading as a permissible skill-based activity and adopt a differentiated regulatory framework instead of a blanket ban.

Government’s Rationale for the Ban

The government, however, has cited grave concerns over the social, economic, and security risks posed by online real-money gaming. In the bill’s preamble, MeitY noted that the rapid proliferation of money-based online games has had a “deleterious effect” on families and society.

Among the issues flagged were:

  • Addiction among children and young adults: The ministry said that the “immersive and addictive nature” of online games with monetary incentives has led to rising cases of anxiety, depression, sleep disorders, and behavioral issues.
  • Financial distress in households: Families have reported heavy monetary losses linked to gaming addiction, sometimes leading to extreme outcomes.
  • Links to illegal activity: Certain platforms, the government claims, have been connected to money laundering, financial fraud, and even terrorism financing, posing a national security risk.

Penalties Proposed in the Bill

The Promotion and Regulation of Online Gaming Bill, 2025 lays out strict penalties for violators:

  • Offering online real-money games could attract up to three years of imprisonment and fines up to ₹1 crore.
  • Promoters, including social media influencers, could face two years of imprisonment and penalties up to ₹50 lakh for advertising or endorsing such platforms.

These stringent provisions signal the government’s intent to create strong deterrents against any circumvention of the ban.

Industry Already Reeling from GST Hike

The bill comes in the wake of another policy change that had already rattled the online gaming sector: the 40% Goods and Services Tax (GST) imposed on real-money games last year, up from 28%.

The move, announced around Diwali in 2024, led to widespread layoffs and restructuring within gaming companies. Startups that had just begun scaling their operations found themselves unable to bear the additional tax burden. Industry leaders fear that the proposed bill could be the final blow.

Balancing Innovation and Regulation

At the heart of the debate lies a fundamental question: how can India strike a balance between curbing the risks associated with online real-money gaming and fostering a sector with immense potential for economic growth?

Industry bodies have suggested alternatives such as:

  • Establishing a central regulatory authority to license and monitor online gaming operators.
  • Imposing age restrictions and robust KYC norms to protect vulnerable groups.
  • Differentiating between games of skill and games of chance, a principle already upheld by several High Courts and the Supreme Court in past judgments.

Such measures, they argue, would ensure player protection while still enabling innovation and investment in the sector.

The tabling of the bill in Parliament is only the first step. It will now be scrutinized by lawmakers, debated in committees, and potentially amended before being passed. However, given the government’s firm stance, industry stakeholders fear that the bill in its current form may move forward without significant dilution.

For now, uncertainty looms large. Employees, entrepreneurs, and investors wait anxiously, wondering whether one of India’s most vibrant digital success stories will be curtailed before it reaches its full potential.

The Online Gaming Bill 2025 encapsulates the tension between regulation and innovation in India’s digital economy. While the government’s concerns over addiction, social harm, and security risks are not unfounded, the industry warns that a blanket ban is too blunt an instrument, one that risks wiping out jobs, investment, and opportunities in a sunrise sector.

As India seeks to position itself as a global technology leader, the outcome of this debate will have far-reaching consequences — not just for the gaming industry but for the country’s broader digital ecosystem.
